k kiosk Tabakshop - General Terms and Conditions
1. Scope of application / general
The k kiosk Tabakshop is the online store of the k kiosk-format for tobacco products ("Tabak Shop") and is operated by Valora Schweiz AG, Hofackerstrasse 40, 4132 Muttenz, Switzerland ("Valora").
These General Terms and Conditions ("GTC") apply to all services offered in the Tabak Shop.
All rights and obligations in connection with the Tabak Shop in accordance with these GTC apply exclusively between Valora and the Customer.
2. Order placement / Conclusion of contract
Orders are placed online via tabak.kkiosk.ch. There is no entitlement to use the Tabak Shop. Access to the Tabak Shop is reserved exclusively for legally competent persons. As the sale of tobacco products to minors is prohibited by law and the protection of minors is our top priority, sales are only made after successful age verification.
In the Tabak Shop, customers can select the products they want and place them in their virtual shopping cart.
Provided that the minimum order value has been reached, the customer is then guided through the order process via the shopping cart.
Once the order process has been successfully completed, the order will be confirmed to the Customer by e-mail. A contract between the Customer and Valora is only concluded when Valora confirms the order. Valora is free to refuse an order - for whatever reason - or its confirmation.
Valora reserves the right to make adjustments to the product range at any time and/or to limit the delivery quantity for certain products or product categories. Details can be found on tabak.kkiosk.ch at the time the order is placed.
3. Customer data and verification
All data required for the order must be provided completely and truthfully by the customer. By placing the order, the accuracy and completeness of all details are confirmed.
For the purpose of age verification, the customer must present a valid identity document during the ordering process.

All information provided by the customer for registration must be complete, correct and personal. The use of third-party email addresses or shared addresses (e.g. family, company or group addresses) is not permitted. The email address provided must be clearly assigned to the verified person and may only be used by that person. An age-verified customer account is non-transferable and may not be shared with other people. A separate account is required for each person.
4. E-newsletter
An e-newsletter with the latest news or special promotions may be sent several times a year to the e-mail address provided during the order process, unless the customer declines to receive the e-newsletter during the order process by deactivating the corresponding tick box.
If the customer gives their consent, they can revoke this at any time by clicking on the corresponding link in the footer of the e-newsletter to unsubscribe.
5. Subsequent changes to orders by the customer
Subsequent changes to orders that have already been confirmed are not possible.
6. Cancellation of orders by Valora
If successful delivery is not possible or only possible under difficult conditions for reasons for which Valora is not responsible (e.g. incorrect delivery address, lack of access authorization, poor weather or traffic conditions, etc.), Valora is entitled to cancel the order. Any claim by the Customer for damages or compensation in kind shall be excluded in full.
If the Customer is responsible for the circumstances (e.g. incorrect delivery address), there is also no entitlement to reimbursement of shipping costs.
7. Availability of products and incomplete fulfillment of the order
We endeavor to ensure the availability of the products offered in the Tabak Shop. In exceptional cases, however, it may happen that for various reasons not enough goods are available or cannot be released for delivery.
In this case, the following applies: If products are not available at the time of the order, the customer will be informed of this fact during the order process, or
if products are not available at the time of delivery, they will be delivered as soon as possible. In the event of permanent unavailability, the affected items will be canceled.
The goods actually received will be stated on the final delivery bill and on the invoice.
The customer shall not be entitled to any claims for compensation or damages in the event of reduced or undelivered quantities.
If an item is invoiced but not delivered, the customer can contact customer service (Clause 16) so that the corresponding amount can be credited to him.
8. Minimum order value
There is no minimum order value per order.
Valora reserves the right to change the minimum order value at any time. Details can be found on tabak.kkiosk.ch at the time the order is placed.
9. Shipping costs
Shipping costs of CHF 6.90 are charged per order. From an order value of CHF 160, shipping is free of charge.
Valora reserves the right to waive shipping costs as part of time-limited promotions.
10. Prices and terms of payment
The prices displayed on tabak.kkiosk.ch at the time of the order shall apply. All prices are in Swiss francs and include the applicable value added tax.
Payment is made by credit card or TWINT via Valora's payment service provider Datatrans, whereby Valora is entitled to add further means of payment and/or involve further payment service providers at its own discretion.
The payment methods that can be selected will be displayed for selection during the order process.
The Customer bears sole responsibility for ensuring that he/she is authorized to use the specified means of payment.
In the tobacco store no k kiosk-vouchers can be accepted for payment.
The invoice and delivery bill will be sent by e-mail after delivery if possible or enclosed directly with the delivery of goods.
11. Deliveries and delivery times
Goods are delivered as quickly as possible and directly to the delivery address and contact person specified by the customer by Swiss Post.
Valora will make every effort to meet the specified delivery times. However, all delivery times stated on tabak.kkiosk.ch are for guidance only.
Non-compliance with delivery times does not entitle the Customer to withdraw from the contract or claim damages.
If the customer is not on site at the time of delivery, the goods will be deposited to the best of our ability in the customer's absence.
When the goods are handed over or deposited, the benefit and risk (in particular the risk of theft, damage by third parties and environmental influences) shall pass to the customer if the order was not sent with A-Post Signature.
When ordering tobacco products, the customer undertakes to ensure that the delivery is accepted by a person of legal age. This applies both to personal delivery by delivery services and to cases where the shipment is left at the door.
12. Notification of defects and reimbursement
12.1 Notification of defects
The goods must be checked for defects and completeness immediately upon receipt. Complaints (missing items, defective goods) can be reported within 7 days by e-mail to tabak@kkiosk.ch or via chat on our website. Otherwise the goods shall be deemed to have been accepted by the customer as faultless. Hidden defects must be reported immediately after their discovery.
12.2 Exchange and complaint process
- Incorrect ordersIf the customer receives a completely incorrect order, it can be returned free of charge. At the customer's request, the order will be resent or the contract will be rescinded.
- Missing productsIf products are missing from the order, they will be delivered at no additional cost.
- Defective productsIn the case of defective products, the customer will receive a voucher code in the amount of the purchase value of the defective product. Alternatively, at the customer's request, a refund can be made to the means of payment used for the purchase.
13. Right of withdrawal
Subject to the cases described in section 12, customers have the right to return items within 7 days of receipt, provided the items are in their original condition and the original packaging is intact.
The return shipment is at the customer's expense. Before returning items, please contact customer service by e-mail at tabak@kkiosk.ch or via the chat function on our website to clarify the return modalities. The purchase price will be refunded to the means of payment used for the purchase upon receipt of the return.
Note: Please note that opened or damaged items as well as products that are not returned in their original packaging are excluded from the right of withdrawal. If such items are nevertheless returned with reference to the right of withdrawal, no refund will be made.
14. Product declaration
The product information published in the Tabak Shop is updated regularly and with the utmost care. In exceptional cases, this information may differ from the information actually printed on the packaging (e.g. in the event of short-term packaging changes). In this case, the information on the packaging is always authoritative.
In the event that the information on the packaging differs from the information on tabak.kkiosk.ch at the time of the order and the customer is therefore unable to consume the product, the customer has the right to demand a credit note for the value of the goods in question. The Tabak Shop customer service (Section 16) must be contacted for this purpose.
15. Guarantee of data communication
Given the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. Valora is not liable for the constant and uninterrupted availability of the Tabak Shop or for technical and electronic errors during a sales transaction, in particular not for delays in the processing or acceptance of orders.
16. Customer service and complaints
Valora's customer service offers information and personal support in the event of questions, problems or complaints regarding the services of the Tabak Shop.

17. Rights of use
The Website and all of its content, including but not limited to all text and images, are the property of Valora or third parties and are protected by copyright with all rights reserved unless otherwise indicated. Any content that is a trademark, logo or service mark is also a registered or unregistered trademark of Valora or third parties. The use of any Content, except as provided in these Terms of Use, is strictly prohibited without the written permission of the owner of the Content. Valora will enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution.
18. Links to third party websites
This website may contain links to other websites that are not owned or operated by Valora. These links are provided for your convenience only. Valora has no control over and is not responsible for the information and privacy practices on or the security of such websites. Valora has not reviewed third party websites that contain links to this website and is not responsible for the content of any third party websites linked to this website. Valora does not endorse the content of such sites. If you establish a link to such sites, you do so at your own risk and without the consent of Valora.
19. General conditions
Valora may amend these GTC at any time. The GTC published on tabak.kkiosk.ch at the time of the order apply to a transaction.
In the event of any ambiguities and/or contradictions between different language versions, the German text shall prevail.
Should parts of these GTC prove to be unenforceable or invalid, this shall not affect the validity of the remaining provisions.
Swiss law shall apply exclusively. The place of jurisdiction is Basel-Stadt or the customer's place of residence.
