This privacy statement describes how your personal data is processed when you visit this website and order products from our Tobacco Shop. In this Privacy Policy, "we", "us" or "our" refers to Valora Schweiz AG, Hofackerstrasse 40, CH-4132 Muttenz ("Valora") as the controller of the Website.

1. collection and use of personal data

When you access our website, the following data is stored in log files: Your IP address, date and time of your access, browser request and general information about your operating system and browser. This usage data is collected based on our legitimate interests in, and for the purpose of, creating, statistical, anonymous evaluations to identify trends to further improve our website and our offerings and to optimize your experience when visiting our website.

In order to receive certain information and services from us, you may be required to provide individual personal information. The following services require that we collect personal data from you:


Tobacco Shop orders

In the Tobacco Shop, you can purchase our products and have them delivered to your home. In this case, you will be asked to provide certain personal data:

  • Contact information: E-mail and telephone number, delivery address, billing address (if different from delivery address)
  • Personal data: Name, first name
  • Copy of a valid identification document
  • Ordered products and subscriptions
  • Means of payment data

Creation of a customer account

Once you have successfully verified your age and created a personal customer account, we will process your email address (unique and exclusively personal) and the data collected during the age verification process to enable you to register and manage your customer account.


We use your data as follows:

  • For the sale and delivery of our products and services, including the processing of orders (e.g., sending order and shipping order confirmations, delivery confirmations, delivery and invoicing);
  • For age verification for reasons of requirements of the Tobacco Products Act and protection of minors.
  • To create and manage a personal customer account, including simplifying future ordering processes, improving account security, and granting a one-time discount when you create an account.
  • To conduct market research.

Details of the processing of payment data:

During the ordering process, you will be asked to provide a valid means of payment. The details of your means of payment are collected via our website directly by our payment service provider Datatrans on its own responsibility. Valora receives from the payment service provider a credit card alias, the card type and the expiration date for the purpose of initiating a payment. We also receive a masked form of the credit card number (for example 123456XXXX7890) in order to be able to allocate incoming payments. News subscription

You can sign up for the e-newsletter. Only your e-mail address is required to sign up for the e-newsletter.

For verification purposes as well as to confirm your consent, we will send you a confirmation e-mail immediately after the order process has been completed. In doing so, we may also store your IP address as well as the date and time of registration.

Our e-newsletters contain tracking pixels that allow log file recording for statistical analysis of our newsletter campaigns. We can see if and when an email was opened and which links were activated in the email. We may engage third parties to provide email marketing services. We, our group-affiliated companies and our service providers only process your personal data collected in this context for email marketing purposes.

You can unsubscribe from all or part of our news communications by contacting us at tabak@kkiosk.ch or by clicking on the unsubscribe link in the footer of any email we send you. Please note that it may take several days to process your email.


Contact form, emails and chat

You may use a contact form to ask questions about us or our products and services. When using the contact form, you will be asked to provide personal information such as your name, address, email address and a message that you would like to send us. You may also contact us directly by email, provided we have provided a specific email address. We may use this information in our legitimate interest to contact you or respond to your message.

In addition, you may contact us via chat (located at the bottom right of the homepage). If you choose to chat with us, we will collect and process the personal and usage data necessary to respond to your request.


2. disclosure of personal data

  • Disclosure to employees and affiliates: Where necessary for the processing purposes set out above, we may disclose your Personal Data to our own employees as well as to our affiliates (regularly within, and only exceptionally outside, Switzerland).
  • Sharing with Processors: We may engage third parties to process your data for the purposes set out above and may transfer your Personal Data to those third parties where necessary. E.g. our customer service provider receives the data necessary for this purpose (including data collected via chat on the website) for the purpose of customer service, and our online store service provider, which provides the store system, has access to all specified customer data as well as all order data or our age verification service provider, which verifies the identity and age of customers in order to comply with the legal requirements of the Tobacco Products Act.
  • Disclosure Related to Financial Transactions: If we are involved in a business combination (merger), joint venture, acquisition or sale of company shares or assets, we may disclose your information to any transaction partner.
  • Disclosure in connection with criminal proceedings: To the extent permitted by law, we may disclose information the disclosure of which is necessary or helpful to investigate or prevent an actual or suspected criminal offense or other violation of our rights or the rights of a third party.

Our processors and Valora Group companies are contractually obliged to process personal data only on our behalf and in accordance with our instructions. In addition, we require them to comply with technical and organisational measures for the protection and security of personal data.

Certain data recipients are located outside of Switzerland and process the data in the following countries: EU member states, the USA, Singapore, Canada and United Kindom. Data protection law in the EU member states provides adequate protection of personal data. For the transfer and processing of data in the USA, Singapore, we have ensured, through appropriate measures, namely the EU Standard Contractual Clauses (including the Swiss appendix), that the respective data recipients maintain an adequate level of data protection.

Our contract processors and Valora Group companies will use personal data only for the agreed purpose and will not sell or otherwise market it to third parties.


3. security and confidentiality

To ensure the security and confidentiality of personal information collected online, we use data networks that are protected by, among other things, industry-standard firewalls and passwords. When handling your personal data, we take reasonable measures to protect it from loss, misuse, unauthorized access, disclosure, alteration or destruction.


4. duration of processing

In principle, we process your data only as long as necessary to fulfill the respective purpose, unless there are legal retention obligations or rights. When the respective purpose is fulfilled, your data will either be deleted or irreversibly anonymized.

Specifically, this means, for example:

If you have consented to receive newsletters or other publications, then we retain the personal data necessary for this until you revoke your consent or unsubscribe from the service.

Personal data that you provide as part of an order process will be stored for as long as we are obliged to store it under tax and commercial law regulations. This period is usually 10 years from the end of the calendar year in which the transaction took place.

Data that you send us in the context of an inquiry, as well as data in the context of an online order are stored for as long as we are obliged to store them due to tax and commercial law regulations. Afterwards, the data will be deleted.

Log and analysis data are stored in personal form for no longer than the duration specified in our Cookie Policy in the section on the respective analysis service. In anonymized, aggregated form, we may retain analytics data for a longer period of time.


5. your rights

You have the following rights in connection with your personal data:

  • Revocation of Consents: For those data processing operations to which you have given your consent (in particular e-newsletters), you have the right to revoke it at any time.
  • Objection: you have the right to object to the processing of personal data concerning you that is carried out on the basis of our legitimate interest.
  • Right of access: You also have the right to find out from us what data we process about you, on what legal basis and for what purposes, and to request a free copy of your personal data.
  • Right to rectification: if your data is incomplete or incorrect, you have the right to request rectification of your personal data. Some information you can do independently in your customer account.
  • Right to erasure: You can request that your personal data be deleted, especially if it is no longer needed for the purposes described.
  • Right to restriction: you can request the restriction of the processing and/or disclosure of your personal data.
    If you wish to exercise your rights, please address your request to our company data protection officer (contact information in section 1).
  • Right of complaint: If you have reason to believe that Valora is not processing your personal data in accordance with the applicable laws and other regulations and/or if you do not agree with the response to your request to grant your rights, you may lodge a complaint with the supervisory authority.

Establishing links to third-party websites is at your own risk. We have not reviewed the third-party websites linked to our website and assume no responsibility for how the website operators process personal data. We recommend that you read the privacy statements of third-party websites in advance.

7. changes to this privacy policy

We reserve the right to change this privacy policy at any time. The last line of this privacy policy reflects the date of the last update. We will mark new versions, e.g. by a "New" label.
